TERMS OF SALE
These Terms of Sale (“Terms”) govern the sale of all pythons by Vibrant Viridis, LLC (“Seller”). By purchasing a python from Seller, the purchaser (“Customer”) acknowledges and agrees to be bound by these Terms.
PAYMENT AND PAYMENT PLANS
Pythons must be paid for in full before shipment. Seller may offer payment plans on a case-by-case basis in Seller’s sole discretion.
GENERAL HEALTH
Unless otherwise disclosed prior to sale, Seller has no knowledge of any python offered for sale having a history of internal or external parasites, respiratory infection, prolapse, kinks, or skin folds. This statement reflects Seller’s knowledge of the python’s history while in Seller’s possession and is not a guarantee against the existence or subsequent development of any health condition or developmental abnormality.
Customer is responsible for properly quarantining all newly acquired animals for an appropriate period of time and for determining what testing, veterinary examination, or other precautions are appropriate before introducing a new python into Customer’s collection. Seller will not be responsible for the illness, injury, or death of any other animal in Customer’s collection, whether allegedly or actually resulting from a python purchased from Seller.
Customer represents that Customer has the knowledge, ability, and experience necessary to properly care for the python purchased. Seller will make reasonable efforts to provide after-sale support and husbandry advice but cannot guarantee that a python will thrive following delivery because husbandry practices, environmental conditions, and other circumstances are outside Seller’s control.
FEEDING
Any representation regarding a python’s feeding history describes its feeding history while in Seller’s care and does not constitute a guarantee that the python will continue to accept the same prey, feed on the same schedule, or feed consistently following delivery.
Pythons may temporarily refuse food as a result of shipping, relocation, changes in husbandry or environmental conditions, breeding behavior, or other causes. This is particularly common in sexually mature males. A refusal to feed following delivery, by itself, does not constitute evidence that the python was unhealthy at the time of sale.
NIDOVIRUSES (SERPENTOVIRUSES)
Seller encourages Customer to test every newly acquired python for nidoviruses (also known as serpentoviruses), regardless of the animal’s source or species.
To be eligible for a refund based on a positive nidovirus test, Customer must: (1) obtain the test sample within seven (7) calendar days after delivery; and (2) notify Seller in writing and provide Seller with a copy of the positive test result within fourteen (14) calendar days after delivery.
If these requirements are satisfied, Seller will provide Customer with a shipping label for return of the python and will issue a full refund of the purchase price upon Seller’s receipt of the returned python.
Seller will have no responsibility for a positive result from a sample collected more than seven (7) calendar days after delivery or for a test result not provided to Seller within fourteen (14) calendar days after delivery.
The warranty and remedy provided in this section are Seller’s sole and exclusive warranty and Customer’s sole and exclusive remedy with respect to nidoviruses (serpentoviruses).
VETERINARY AND OTHER EXPENSES
Customer is solely responsible for all veterinary, diagnostic, testing, treatment, medication, necropsy, and other expenses incurred after delivery. Seller will not reimburse Customer for any such expense unless Seller expressly agrees in writing to the expense before it is incurred.
PHOTOGRAPHS, COLOR, AND APPEARANCE
Seller makes reasonable efforts to provide photographs that accurately depict each python offered for sale. Customer acknowledges, however, that an animal’s appearance and perceived coloration may vary due to lighting, photography, camera and display characteristics, viewing conditions, shedding cycles, age, and other factors.
Green tree pythons may also undergo substantial natural changes in coloration and appearance as they mature. Seller does not guarantee that a python’s current coloration, pattern, or other appearance will remain unchanged or that the python will develop any particular adult coloration or appearance.
SHIPPING
Unless otherwise stated, shipping within the United States is included in the purchase price.
Seller ships via FedEx and generally requires packages to be held for pickup at a staffed FedEx facility. Seller may postpone shipment whenever Seller determines that weather conditions, carrier conditions, or other circumstances could jeopardize the health or safety of the python.
Seller and Customer will coordinate an appropriate shipping date. Customer is responsible for providing complete and accurate shipping and contact information, confirming the appropriate FedEx pickup location, being available to retrieve the shipment, and promptly retrieving the package when it becomes available.
Seller is not responsible for delays, routing errors, missed delivery commitments, or other acts or omissions of the shipping carrier. Notwithstanding the foregoing, a carrier delay will not, by itself, invalidate the Live Arrival Guarantee if Customer otherwise satisfies the requirements of that guarantee.
LIVE ARRIVAL GUARANTEE
Seller guarantees live arrival only if all of the following conditions are satisfied:
Customer retrieves the package within one (1) hour after FedEx makes it available for pickup;
Customer notifies Seller of any problem within two (2) hours after retrieving the package; and
In the event of a deceased python, Customer provides Seller with clear photographs sufficient to document the condition of the python.
If a python arrives deceased and Customer has satisfied all of the foregoing requirements, Seller will provide Customer with a full refund of the purchase price.
If Customer requests delivery directly to a residence or other address rather than pickup at a staffed FedEx facility, or if hold-for-pickup service is unavailable, the Live Arrival Guarantee does not apply.
INTERNATIONAL SHIPPING
Seller may facilitate exportation to Canada and Europe on a case-by-case basis. Customer is responsible for all shipping, export, import, permitting, documentation, brokerage, and other associated fees and expenses.
SEXING POLICY
When Seller identifies a python as male or female, the python is sexed based on genetic testing of a shed skin sample performed through the sex-testing service offered by Phenome.
Seller relies on the results reported by Phenome and does not independently verify the accuracy of those results. Accordingly, Seller does not guarantee the sex of any python and disclaims responsibility or liability for any inaccurate sex determination or test result, including any python subsequently determined to be a sex different from that reported by Phenome.
Customer acknowledges and accepts the possibility of an inaccurate sex determination as a condition of purchase.
COMPLIANCE WITH LAWS
Customer is solely responsible for determining whether the purchase, possession, transportation, importation, and ownership of the python are lawful at Customer’s location and for obtaining any permits, licenses, or other governmental approvals required for possession or receipt of the python.
Seller will not be responsible for Customer’s failure to comply with any applicable federal, state, provincial, local, or other law or regulation.
RETURNS AND CANCELLATIONS
Except for a refund or other remedy expressly provided by these Terms, all sales are final. Seller is not required to accept a return, exchange an animal, or provide a refund because Customer changes Customer’s mind, no longer wants the python, is dissatisfied with its appearance, or experiences a change in personal circumstances.
Any cancellation or refund permitted by Seller outside the express remedies provided in these Terms is within Seller’s sole discretion.
NON-TRANSFERABILITY
The warranties, guarantees, and remedies provided by these Terms are solely for the benefit of the original Customer and may not be assigned or transferred to any subsequent purchaser, owner, or other person.
LIMITATION OF REMEDIES AND LIABILITY
Except for the specific warranties and remedies expressly provided in these Terms, Seller makes no warranties, express or implied, regarding any python sold by Seller to the fullest extent permitted by applicable law.
To the fullest extent permitted by applicable law, Seller’s aggregate liability arising out of or relating to the sale of any python will not exceed the purchase price actually paid to Seller for that python.
Seller will not be liable for any indirect, incidental, special, exemplary, or consequential damages arising out of or relating to the purchase, ownership, condition, illness, injury, or death of any python, including veterinary or diagnostic expenses, loss of breeding opportunities, loss of anticipated offspring, loss of anticipated value, lost profits, or illness, injury, or death of other animals.
The limitations in this section do not eliminate or reduce any refund or other remedy expressly provided under the Nidoviruses (Serpentoviruses) or Live Arrival Guarantee sections of these Terms.
GOVERNING LAW AND VENUE
These Terms and any dispute arising out of or relating to the purchase or sale of a python will be governed by the laws of the State of Colorado, without regard to its conflict-of-laws principles.
To the extent permitted by applicable law, Customer agrees that any legal action or proceeding arising out of or relating to these Terms or the purchase or sale of a python will be brought exclusively in the state or federal courts located in Colorado, and Customer consents to the personal jurisdiction of those courts.
ENTIRE AGREEMENT
These Terms, together with any written disclosures or terms specifically applicable to the python purchased, constitute the agreement between Seller and Customer concerning the matters addressed herein. No oral statement or representation modifies these Terms unless expressly agreed to in writing by Seller.
